Non-Exclusive
What is a non-exclusive license?
A non-exclusive license is where you choose an existing design from my portfolio to be manufactured by the printer of your choice, and sold as finished goods in one category. The design may also be licensed non-exclusively to other companies at the same time and will remain for sale on sites such as Spoonflower and Society6, where other people may purchase the design printed onto fabric, wallpaper, and other goods. I retain the copyright.
Exclusive
What is an exclusive license?
Usage terms for an exclusive license are negotiated and agreed upon by all parties before any design work starts. An Exclusive Licensing Agreement is drawn up to document how the design may be used, which is signed and dated by all parties. As the designer, I retain the right to use the design during the licensing period for any other purpose not specified in the licensing agreement (for example, if you have exclusively licensed a design in the category of Greeting Cards, I may also license the design within a different category such as Baby Goods or Phone Accessories).
Leading up to the expiration of the licensing period, you will receive the first option to renew the design. If you choose not to re-license the design, the right to use the design reverts back to me as the designer.
Who owns the copyright and/or the design?
As the designer, I retain all copyright and ownership of the artwork and all derivative works at all times.
